Your use of the Intellirent website (www.myintellirent.com and variants thereof), mobile application, and/or Intellirent services including but not limited to it's Intellirent product, and your transactions conducted with the company in connection with this website are subject to the following terms and conditions, also referred to "Terms of Use". Clicking onto web pages beyond the website's homepage constitutes your acceptance of and agreement with the Terms of Use whether or not you complete a transaction with the company and whether or not you complete your transaction on the website or through other channels, such as by phone, by Email, facsimile or otherwise. You further acknowledge that you have read, understood, and agree to be bound by all consents and disclosures that may be set forth in the registration process (and hereby incorporated herein by this reference). If you do not agree to the Terms of Use, do not use this website or any Intellirent services.
Permitted Use
You agree that:
- your use of this website is subject to and governed by these Terms of Use,
- you will only access or use this website and transact business with us if you are at least 18 years old,
- you will comply with and be bound by these Terms of Use as they appear on this website each time you access and use this website,
- each use of this website by you indicates and confirms your assent to and agreement to be bound by these Terms of Use, and
- these Terms of Use are a legally binding agreement between you and Intellirent that will be enforceable against you.
You agree that you will not use or attempt to use this website for any purpose other than conducting resident screening related business with Intellirent as a bona fide client of Intellirent; you may not use or attempt to use this website or any part of this site for any purpose:
- Bail bond enforcement or bounty hunters
- Internet people locator services
- Diet centers
- Adoption search firms
- Credit repair companies or credit clinics
- Non-Credit Repair Organizations Act (CROA) for-profit credit counseling
- Loan modification companies
- Debt settlement companies
- Investigative companies, including private investigators and detective agencies
- Media agencies, news agencies or journalists
- Law enforcement
- Non-governmental agencies or businesses associated with the collection of child support
- Companies or individuals identified on Experian end user Alert List
- Businesses operating out of residence except where provided in policy
- Dating services
- Asset location services
- Condominium/Homeowners associations
- Future services (i.e., health clubs, continuity clubs, etc.)
- Country clubs
- Timeshare
- Companies involved and/or associated with inappropriate adult content websites and/or adult type telephone services
- Any company or individual who is known to have been involved in credit fraud or other unethical business practices
- Any person or entity which Intellirent knows, or suspects may be engaged in fraudulent or illegal activity, such as identity theft, harassment or stalking
- Any company or individual listed on Departments of Commerce, State and the Treasury lists Export website https://www.export.gov/article2?id=Consolidated-Screening-List
You understand that Intellirent may obtain one or more consumer reports, which may contain public information, for the purposes of resident screening and acknowledge responsibilities under FCRA:
- The Fair Credit Reporting Act allows me to obtain a disclosure from every credit reporting agency of the nature and substance of all information in my file at the time of the request. Full disclosure of information in your file at Experian must be obtained directly from Experian by calling 888-397-3742 or logging on to www.experian.com/consumer. The credit report you are requesting from Intellirent is not intended to constitute the disclosure of Experian information required by the Fair Credit Reporting Act or similar state laws.
- I am entitled to receive a disclosure directly from the consumer reporting agency free of charge under the following circumstances:
a. I have been denied credit, insurance or employment within the past sixty (60) days as a result of my credit report
b. I certify in writing that I am unemployed and intend to apply for employment in the sixty (60) day period beginning on the date on which I made the certification
c. I am a recipient of public welfare assistance
d. I have reason to believe that my file at the agency contains inaccurate information due to fraud
e. Annually at www.annualcreditreport.com
Otherwise, the consumer reporting agency may impose a reasonable charge for the disclosure. - The Fair Credit Reporting Act permits me to dispute inaccurate or incomplete information in my credit file. I understand that accurate information cannot be changed. To begin a dispute contact us, call 1(844)755-4059 or email support@myintellirent.com.
- I do not have to purchase my credit report or other information from Intellirent to dispute inaccurate or incomplete information in my Experian file or to receive a copy of my Experian consumer credit report.
- Experian’s National Consumer Assistance Center provides a proprietary consumer disclosure that is different from the consumer credit report provided by Intellirent. The disclosure report must be obtained directly from Experian. Consumers residing in the States of Colorado, Massachusetts, Maryland, New Jersey, and Vermont may receive a free copy of their consumer credit report once per year and residents of the State of Georgia may receive two (2) copies per year.
- Fraud Alerts are available to any eligible consumers—free of charge—from a national consumer reporting agency.
- I have the right to purchase a consumer credit score directly from Experian.
California Residents
Under Section 1786.22 of the California Civil Code, if you wish to dispute the accuracy or completeness of any item in the consumer report, you may contact the consumer reporting agency named above and request an investigation. You also may view the file maintained on you by the above credit reporting agency during normal business hours. You can receive a copy of your file by providing proper identification and paying any related-copy costs. You may also receive a summary of the file by telephone. The agency is required to have employees available to explain your file to you, and they must explain any coded information in your file. You can bring someone with you to view the file, so long as they have identification.
VantageScore® credit score
Intellirent utilizes the VantageScore® credit score. The VantageScore credit score may or may not be used by Applicant’s lenders, and is not an endorsement or guarantee of Applicant’s credit worthiness as seen by lenders.
Please be aware that there are many scoring models used in the marketplace. Each scoring model may have its own set of factors and scale. The information and credit scoring may be different than that used by a lender. The VantageScore credit score may not be identical in every respect to any other credit score produced by another company or used by Report Subject’s lender.
Applicant’s VantageScore credit score is calculated using Applicant’s actual data from Applicant’s credit file at the time of Intellirent’s request. Keep in mind, however, that other factors, such as length of employment and annual salary, are often taken into consideration by lenders when making decisions about Applicant. How each lender weighs its chosen factors may vary, but the exact formula used to calculate Applicant’s score is proprietary. Also note that each consumer reporting agency has its own set of data, resulting in a separate VantageScore credit score for each of Report Subject’s credit files.
You agree to request VantageScore credit scores only for your use alone for the purposes certified to Intellirent and for no other purpose or use. All VantageScore credit scores provided hereunder will be held in strict confidence and may never be sold, licensed, copied, reused, disclosed, reproduced, revealed or made accessible, in whole or in part, to any person except as required by law or as otherwise set forth in your agreement with Intellirent.
VantageScore® is owned by VantageScore Solutions, LLC.
Payment
All amounts are non-refundable, non-cancelable and non-creditable. Applicant agrees that the fee is non-refundable and may not be refunded for any reason (including application denial, applicant withdrawal of application, or apartment availability). Such payment is part of the rental screening process and is a charge for processing all background information, verifying application data and delivery to the leasing agent.
Use License
Permission is granted for temporarily access of materials (information or software) on Intellirent Solutions, Inc.'s website for rental screening, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on Intellirent Solutions, Inc.'s website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Intellirent Solutions, Inc. at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any materials in your possession whether in electronic or printed format.
Privacy
We collect certain data and information about you in connection with your use of the Intellirent Products and otherwise in connection with these Terms. We collect and use all such data and information in accordance with our Privacy Policy, which you acknowledge.
Disclaimer
The materials on Intellirent Solutions, Inc.'s website are provided on an 'as is' basis. Intellirent Solutions, Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Intellirent Solutions, Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Limitations
In no event shall Intellirent Solutions, Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Intellirent Solutions, Inc.'s website, even if Intellirent Solutions, Inc. or a Intellirent Solutions, Inc. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
